    • in writing to the Seller’s registered office address.
  2. The complaint should preferably include contact details and a description of the issue.
  3. Failure to provide the above information does not automatically result in rejection of the complaint.
  4. The Seller will respond to the complaint no later than within 14 days of receipt, unless applicable law provides for a different period.

4. PRODUCTS, PRICES AND PROMOTIONS

  1. Information about Products displayed in the Store constitutes an invitation to enter into a contract and does not constitute an offer within the meaning of the Polish Civil Code.
  2. The key information concerning a Product is presented on the Product Page.
  3. Product Prices are gross prices and include taxes applicable to the relevant sale, unless the nature of a cross-border transaction requires a different tax treatment disclosed to the Customer before the Order is placed.
  4. Delivery costs are not included in the Product Price unless expressly stated otherwise for a particular offer.
  5. The total cost of the Order, including the Price of the Products and the cost of the selected delivery method, is displayed to the Customer before the Order is placed.

PROMOTIONS AND PRICE REDUCTIONS

  1. Where the Seller announces a reduction in the Price of a Product, the reduced Price is accompanied by information on the lowest Price of that Product applied during the 30 days preceding the reduction.
  2. If the Product has been offered in the Store for less than 30 days, the lowest Price applied from the date on which the Product was first offered until the date of the reduction is displayed.
  3. The Seller may organise promotions, special campaigns, discount codes or promotional programmes under separate terms or the conditions of the relevant campaign.
  4. Promotions do not limit the statutory rights of Consumers or Entrepreneurs with Consumer Rights.
  5. If the Seller uses personalised pricing based on automated decision-making in the future, the Customer will be informed of this before placing the Order.

5. PLACING AN ORDER AND CONCLUSION OF A SALES CONTRACT

  1. The Customer places an Order by:
    • selecting a Product,
    • selecting an available Product variant, e.g. size,
    • adding the Product to the Cart,
    • providing the information required to fulfil the Order,
    • selecting a delivery method,
    • selecting a payment method,
    • reviewing the Order summary,
    • accepting these Terms & Conditions,
    • placing the Order using a button or similar function clearly indicating that placing the Order entails an obligation to pay.
  2. Before placing the Order, the Customer may review and correct the information entered.
  3. Placing an Order constitutes an offer by the Customer to enter into a Sales Contract.
  4. After the Order is placed, the Seller sends confirmation of receipt to the e-mail address provided by the Customer.
  5. The Sales Contract is concluded when the Seller sends the Customer a message confirming acceptance of the Order for fulfilment.
  6. In the case of electronic payments, acceptance of the Order for fulfilment may take place after confirmation that payment has been successfully made or, in the case of deferred payment, that financing has been granted.
  7. Confirmation of conclusion of the Sales Contract and the information required by law are provided to the Customer on a durable medium, in particular by e-mail.
  8. The Seller may contact the Customer where fulfilment of the Order requires clarification of data or other information necessary for its performance.
  9. Products displayed in the Store are available in quantities corresponding to current stock levels unless otherwise indicated in the Product description.
  10. If an Order cannot be fulfilled due to a Product being unavailable, the Seller will inform the Customer without undue delay.
  11. If a Product becomes unavailable after an Order has been placed, the Seller will inform the Customer without undue delay and refund payments received in respect of the unavailable Product, including delivery costs to the extent required by applicable law.

6. PAYMENT METHODS

  1. The Seller makes the following payment methods available:
    • payment card,
    • BLIK,
    • instant electronic bank transfer,
    • PayPo.
  2. The availability of individual payment methods may depend on the Customer’s country, currency, Order value or services made available by the payment provider.
  3. Current payment methods are always displayed before the Order is placed.
  4. Electronic payments may be processed by third-party payment service providers.
  5. When using PayPo, the Customer also uses the deferred payment service provided by that provider under its own terms.
  6. The Seller does not store Customers’ full payment card details where those details are processed directly by the payment provider.
  7. Seller’s bank account:
    mBank
    29 1140 2004 0000 3102 7923 5729
  8. Inclusion of the bank account number in these Terms & Conditions does not mean that a traditional bank transfer is a standard payment method in the Store. It may be used for settlements individually agreed with the Seller.

7. DELIVERY WITHIN POLAND

  1. Within Poland, the Seller makes available in particular the following delivery methods:
    • InPost Paczkomat®,
    • InPost Courier.
  2. The current delivery cost is indicated to the Customer each time before the Order is placed and depends on the selected delivery method and delivery destination.
  3. Availability of a particular delivery method may depend on:
    • parcel dimensions,
    • number of Products,
    • delivery location,
    • Order value,
    • carrier restrictions.
  4. The standard time for preparing an available Product for dispatch is up to 48 hours from acceptance of the Order for fulfilment.
  5. The carrier’s transit time must be added to the Order preparation time.
  6. The 48-hour preparation period does not apply to Products offered on a pre-order basis, for which the timeframe indicated on the Product Page applies.
  7. If exceptional circumstances prevent fulfilment within the standard timeframe, the Seller will inform the Customer of the delay and the estimated fulfilment date.
  8. The above does not limit the Customer’s statutory rights in the event that the agreed delivery deadline is not met.

8. INTERNATIONAL DELIVERY

  1. STD WEAR fulfils Orders to selected countries outside Poland.
  2. International shipments may be handled in particular by:
    • UPS,
    • DPD,
    • FedEx,
    • GLS.
  3. The available carrier depends on the delivery country and the parameters of the Order.
  4. Available delivery countries, carriers, delivery costs and estimated delivery times are displayed to the Customer before the Order is placed.
  5. For deliveries to destinations where the sale is not subject to a common customs or tax regime, the shipment may be subject to customs duties, import taxes or other charges imposed under the laws of the destination country.
  6. If such charges have not been collected by the Seller during checkout, they may be collected by the competent authority, carrier or another authorised entity.
  7. The Seller has no control over the time required for customs clearance by the authorities of the destination country.
  8. The Customer shall provide address details sufficient to enable correct delivery in the destination country.

9. PRE-ORDER

  1. Selected Products may be offered on a pre-order basis.
  2. A Product offered on a pre-order basis is clearly identified as such on the Product Page.
  3. For a pre-order Product, the Seller indicates the estimated dispatch date or fulfilment period.
  4. The standard 48-hour Order preparation period does not apply to pre-order Products.
  5. Ordering a pre-order Product means that the Customer agrees to fulfilment within the timeframe indicated on the Product Page, without prejudice to the Customer’s mandatory statutory rights.
  6. If the estimated pre-order fulfilment date changes, the Seller will inform the Customer of the new estimated date.
  7. If the change is material, the Customer may exercise the rights available under applicable law, including, where the relevant conditions are met, withdrawing from further performance of the Order.
  8. If one Order includes both an immediately available Product and a pre-order Product, the Order may be dispatched once all Products are available, according to the timeframe applicable to the Product available latest, unless:
    • the Store offers separate delivery, or
    • the Customer agrees another method of fulfilment with the Seller.
  9. A Product offered on a pre-order basis is not, solely for that reason, a Product made to the Customer’s individual specifications.
  10. The mere fact that a Product was purchased on a pre-order basis does not exclude the statutory right of withdrawal from the Sales Contract.

10. RECEIPT OF AND DAMAGE TO SHIPMENTS

  1. Upon receipt of a shipment, the Customer may inspect the condition of its packaging.
  2. If the shipment shows visible signs of damage, the Customer is advised to prepare a damage report with the carrier and take photographs.
  3. A damage report may facilitate establishing the circumstances of the damage.
  4. Failure to prepare a damage report does not deprive a Consumer or an Entrepreneur with Consumer Rights of the right to submit a complaint to the Seller.
  5. In the case of a Consumer, the risk of accidental loss of or damage to the Product generally passes to the Consumer only when the Product is delivered to the Consumer or to a third party designated by the Consumer other than the carrier, subject to exceptions provided for by applicable law.

11. PRODUCT COMPLAINTS – LACK OF CONFORMITY WITH THE CONTRACT

  1. The Seller is liable to the Consumer for the conformity of the Product with the Sales Contract in accordance with the Polish Act of 30 May 2014 on Consumer Rights.
  2. This Section applies accordingly to an Entrepreneur with Consumer Rights to the extent provided for by applicable law.
  3. The Seller is liable for a lack of conformity of the Product with the Sales Contract existing at the time of delivery and disclosed within two years from that time, unless applicable law provides for a longer period.
  4. A complaint may be submitted:
    • by e-mail to info@stdwear.com,
    • in writing to the Seller’s registered office address.
  5. If the Product needs to be sent to the Seller in order for the complaint to be considered, the method of shipment should first be agreed with the Seller and the Product sent to: STD WEAR / STOREIT ul. Brukowa 20 91-341 Łódź Poland
  6. To facilitate handling, the complaint should preferably state:
    • full name,
    • Order number,
    • Product concerned,
    • description of the identified lack of conformity,
    • Customer’s requested remedy,
    • contact details.
  7. Providing the above information is recommended for efficient handling of the complaint, but failure to provide it does not in itself deprive the Customer of the right to complain.
  8. A receipt is not required in order to submit a complaint if the Customer can otherwise demonstrate that the purchase was made from STD WEAR.

REPAIR OR REPLACEMENT

  1. If the Product is not in conformity with the Sales Contract, the Consumer may request:
    • repair, or
    • replacement.
  2. The Seller may replace the Product where the Consumer requests repair, or repair the Product where the Consumer requests replacement, if the remedy chosen by the Consumer is impossible or would impose disproportionate costs on the Seller.
  3. If both repair and replacement are impossible or would impose disproportionate costs, the Seller may refuse to bring the Product into conformity with the Sales Contract.
  4. Repair or replacement shall be carried out within a reasonable time and without significant inconvenience to the Consumer.
  5. The Seller bears the costs of repair or replacement, including in particular the cost of shipping the Product subject to the complaint.

PRICE REDUCTION OR WITHDRAWAL FROM THE CONTRACT

  1. The Consumer may make a statement requesting a Price reduction or, where the lack of conformity is significant, withdraw from the Sales Contract in the circumstances provided for by applicable law, in particular where:
    • the Seller has refused to bring the Product into conformity with the Sales Contract,
    • the Seller has failed to bring the Product into conformity with the Sales Contract,
    • the lack of conformity persists despite an attempt to remedy it,
    • the lack of conformity is sufficiently serious to justify an immediate Price reduction or withdrawal from the Sales Contract,
    • it is clear from the Seller’s statement or the circumstances that the Product will not be brought into conformity within a reasonable time or without significant inconvenience to the Consumer.
  2. The Consumer may not withdraw from the Sales Contract if the lack of conformity is minor. Under Polish consumer law, a lack of conformity is presumed to be significant.
  3. In the event of a Price reduction, the Seller will refund the amount due without undue delay and no later than within 14 days of receiving the Consumer’s statement requesting a Price reduction.
  4. In the event of effective withdrawal from the Sales Contract due to lack of conformity:
    • the Consumer returns the Product at the Seller’s expense,
    • the Seller refunds the Price within the period required by applicable law.
  5. The Seller will respond to a Consumer complaint within 14 days of receipt.
  6. Failure to respond within the statutory period has the consequences provided for by applicable law.

12. RIGHT OF WITHDRAWAL – RETURN OF PRODUCTS

  1. A Consumer and an Entrepreneur with Consumer Rights may withdraw from a Sales Contract concluded through the Store without giving any reason within 14 days.
  2. In the case of a Sales Contract for a Product, the withdrawal period begins on the day on which the Consumer or a third party designated by the Consumer other than the carrier takes possession of the Product.
  3. If one Sales Contract covers multiple Products delivered separately, in batches or in parts, the period begins when the Consumer takes possession of the last Product, batch or part.
  4. To meet the deadline, it is sufficient to send the statement of withdrawal before the withdrawal period expires.
  5. The statement may be submitted in particular:
    • by e-mail to info@stdwear.com,
    • in writing to the Seller’s address,
    • using the model withdrawal form,
    • using an electronic return functionality, if made available in the Store.
  6. Use of the model form is not mandatory.
  7. The Consumer shall return the Product no later than within 14 days from the date of withdrawal from the Sales Contract.
  8. Products returned following withdrawal from the Sales Contract should be sent to:
    STD WEAR / STOREIT
    ul. Brukowa 20
    91-341 Łódź
    Poland
  9. The Customer bears the direct cost of returning the Product in the event of statutory withdrawal, unless the Seller expressly states that it will bear that cost in a particular case.
  10. The above rule also applies to returns sent from outside Poland.
  11. The Seller will refund all payments received from the Consumer in respect of the returned Product, including the cost of delivering it to the Consumer up to the amount corresponding to the least expensive standard delivery method offered by the Seller for the relevant Order.
  12. If the Consumer selected a more expensive delivery method, the Seller is not required to reimburse the additional cost resulting from that choice.
  13. The refund will be made no later than within 14 days from the date on which the Seller receives the Consumer’s statement of withdrawal.
  14. The Seller may withhold the refund until:
    • the Product has been received back, or
    • the Consumer provides evidence of having returned it,
    whichever occurs first.
  15. The refund will be made using the same payment method used by the Consumer, unless the Consumer expressly agrees to another method that does not result in any additional costs for the Consumer.
  16. The Consumer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning.
  17. In the case of clothing, the Consumer may inspect and try on the Product to an extent comparable to what would be possible in a physical store.
  18. The Product should be appropriately protected for return transport.
  19. The absence of the original packaging does not in itself deprive the Consumer of the right of withdrawal, unless the packaging is an integral part of the Product and its absence affects the Product’s value.

13. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  1. The right of withdrawal does not apply in the cases specified in Article 38 of the Polish Act of 30 May 2014 on Consumer Rights.
  2. In particular, this may apply to contracts concerning a Product:
    • which is non-prefabricated and made to the Consumer’s specifications or clearly personalised,
    • supplied in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging has been opened after delivery,
    • which, after delivery, becomes inseparably mixed or combined with other items due to its nature,
    • and in other cases provided for by applicable law.
  3. STD WEAR does not currently envisage the standard sale of Products made to the Customer’s individual specifications.
  4. A pre-order Product is not a personalised Product solely because it was ordered before becoming generally available.

14. OUT-OF-COURT DISPUTE RESOLUTION

  1. A Consumer may use out-of-court complaint handling and redress procedures.
  2. Information on available options may be obtained in particular from:
    • a district or municipal consumer ombudsman in Poland,
    • the competent Provincial Inspectorate of Trade Inspection in Poland,
    • consumer organisations,
    • information made available by the Polish Office of Competition and Consumer Protection (UOKiK),
    • the register of entities authorised to conduct out-of-court consumer dispute resolution proceedings.
  3. In cross-border disputes, a Consumer may also seek assistance from the competent European Consumer Centre.
  4. Use of an out-of-court dispute resolution method is voluntary unless mandatory provisions provide otherwise.
  5. Where required by law, the Seller will inform the Consumer whether it agrees to participate in a specific out-of-court dispute resolution procedure.

15. PERSONAL DATA AND COOKIES

  1. The controller of personal data processed in connection with use of the Store is:

  3. Detailed information concerning the use of cookies and similar technologies is set out in the STD WEAR Cookie Policy.
  4. Marketing consents are voluntary and separate from acceptance of these Terms & Conditions.
  5. Refusal to provide marketing consent does not prevent the Customer from making a purchase.

16. INTELLECTUAL PROPERTY RIGHTS

  1. Content available in the Store, including in particular:
    • the STD WEAR name,
    • logos,
    • photographs,
    • videos,

    • visual identity elements,
may be protected by copyright, trade mark rights and other intellectual property rights.
  2. Such materials may be used only as permitted by applicable law or with the consent of the relevant rights holder.
  3. Copying or using Store materials for commercial purposes without an appropriate legal basis is prohibited.

17. BUSINESS CUSTOMERS

  1. This Section applies exclusively to Customers entering into a contract in connection with their trade, business or profession who, in relation to the relevant contract, are not entitled to the protection granted to an Entrepreneur with Consumer Rights.
  2. Provisions limiting the Seller’s liability do not apply to Consumers or Entrepreneurs with Consumer Rights to the extent required by applicable law.
  3. In the case of a business Customer who is not a Consumer, the risk of accidental loss of or damage to the Product passes to the Customer when the Product is handed over to the carrier, unless mandatory law provides otherwise.
  4. To the extent permitted by law, the Seller’s statutory warranty liability (rękojmia) towards a Customer who is a business is excluded.
  5. To the extent permitted by law, the Seller’s liability towards a business Customer:
    • is limited to actual losses,
    • does not include loss of profits,
    • is limited to the value of the Sales Contract from which the relevant claim arises.
  6. The above limitations do not apply to damage caused intentionally or in other cases where exclusion or limitation of liability is not permitted by law.
  7. Disputes between the Seller and a business Customer who is neither a Consumer nor an Entrepreneur with Consumer Rights shall, to the extent permitted by applicable law, be submitted to the court having jurisdiction over the Seller’s registered office.

18. AMENDMENTS TO THESE TERMS & CONDITIONS

  1. The Seller may amend these Terms & Conditions for valid reasons, in particular in the event of:
    • changes in applicable law,
    • changes to the Seller’s details,
    • changes to payment methods,
    • changes to delivery methods,
    • introduction of new Store functionalities,
    • changes to the scope of Electronic Services,
    • changes to technical solutions used,
    • the need to ensure Store security.
  2. An amendment to these Terms & Conditions does not affect rights already acquired by Customers.
  3. Sales Contracts concluded before a new version of these Terms & Conditions takes effect remain subject to the version in force when the relevant Sales Contract was concluded.
  4. Customers holding an Account will be informed in advance, on a durable medium where required by law, of amendments affecting services provided on a continuous basis.
  5. A Customer who does not accept amendments affecting the Account or another Electronic Service provided for an indefinite period may terminate the agreement concerning that service.

19. FINAL PROVISIONS

  1. These Terms & Conditions shall be governed by Polish law.
  2. If a Consumer has their habitual residence outside Poland, the choice of Polish law does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence, where such provisions apply to the relevant Sales Contract.
  3. These Terms & Conditions do not exclude or limit any statutory rights of Consumers or Entrepreneurs with Consumer Rights.
  4. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in force to the extent permitted by law.
  5. Matters not regulated by these Terms & Conditions are governed by applicable law, including in particular:
